Brown v. Board of Education took place in the early 1950’s. Before Brown v. BOE, there was a precedent of “separate but equal”. Brown v.. Board argued that educational facilities separated by race were inherently unequal. Because of this ruling, schools were supposed to be integrated. Some places didn’t end up integrating schools until forced by military or federal pressures, up to twenty-five years later. The Supreme Court at this time was made up of nine white men, however there was a liberal majority. The Chief Justice was Earl Warren, who at the time belonged to the Republican Party but soon after was a part of the Democrat Party. The Amendment that’s closest related to the case is the 14th Amendment which states that all Americans are equally protected. They are related because both are about equality for all Americans. It is related to racially charged issues today because it directly addresses racial inequality, however it clearly did not solve the issues related not only to the precedent of “separate but equal” but also to the idea of integration being fully and successfully integrated. This is clear through the segregation, injustice, and gentrification that affects people of color, especially in regard to schools.
Roe v. Wade took place in the early 1970’s. It defended a woman’s right to an abortion. The case started when Norma McCorvey, known in court as Jane Roe, wanted an abortion but was unable to get one because it was illegal in Texas. The Chief Justice, Warren Burger, was Republican. The case passed in a 7-2 decision. It directly relates to the Fourteenth Amendment because that is the amendment that they used for it to pass. It relates to women’s rights issues today because women still fight for their rights to aboritions. Under the Trump Administration, many women’s reproductive rights have been under attack, specifically in conservative states.
Citizens United v. FEC took place in 2010. This case made it so that donating money to political campaigns is considered free speech. This means that people are able to donate as much money as they want to politicians. Anthony Kennedy was the swing vote on the majority conservative Supreme Court. John Roberts, a Republican, was the Chief Justice. This case directly connects to the First Amendment because it makes it so donating money to politicians is considered free speech. It gives wealthier people much more say in politics today.
